Madigan calls for urgent scrutiny of Australia’s extradition laws

Independent Senator for Victoria John Madigan has called for an urgent review of Australia’s extradition laws, saying every Australian is at risk.

Senator Madigan said the current laws had the potential to see the “hijacking of Australian citizens by selected foreign governments” and were having a detrimental impact on the lives of Australian citizens.

“Any one of us can be deported at the behest of a foreign country without trial or any presumption of innocence,” Senator Madigan said.

“China is a country where criminal trials are initiated at the whim of the ruling party, held in secret, and where the conviction rate hovers around 100 per cent.

“Many Australians will therefore be shocked to learn that the Turnbull Government is considering entering a treaty with China that would allow the extradition of Australians to face the Chinese judicial system.

“They would be even more shocked to learn that under Australia’s current legislation, the Extradition Act 1988, there is a ‘no evidence’ rule, meaning that a country seeking extradition of a person from Australia need not produce evidence of the alleged charge.”

In a Senate speech on the issue, Senate Madigan referred to the case of Mr Krunoslav Bonic who was arrested in September 2014 pursuant to a warrant under an extradition request from Bosnia for allegedly engaging in war crimes during the Bosnian War in the 1990s.

“Correspondence sent to the Australian Government on behalf of Mr Bonic details the torture he faced during almost 12 months as a Prisoner of War,” Senator Madigan said.

“Despite this, the Australian Government continued to facilitate the extradition request to the foreign state where Mr Bonic suffered.”

Senator Madigan called on the government to acknowledge Mr Bonic’s current claim for defective administration and urged the government to immediately review our extradition laws.

我比較懷疑問題是不是在於護照沒有塞美金.

至於後續中共不鳥，要罵政府不夠力的話，這就有點見仁見智了~
到底希望政府要強硬到何種地步，每個人的標準都不太一樣，
畢竟有些強硬行為，也會傷到自己。
